Terms of Service.

1. Acceptance of Terms

By accessing or using CapBypass ("the Service"), operated at capbypass.pro, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

We reserve the right to modify these terms at any time. Continued use after changes constitutes acceptance of the updated terms.

2. Description of Service

CapBypass provides an API platform for automated CAPTCHA solving using machine learning and neural networks. The Service includes the web dashboard, API endpoints, documentation, and related tools.

3. Account Registration

  • You must be at least 18 years old to create an account
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials and API keys
  • You are responsible for all activity that occurs under your account
  • One account per person — multiple accounts are not permitted

4. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Engage in fraudulent, deceptive, or malicious activities
  • Distribute malware, spam, or other harmful content
  • Attempt to gain unauthorized access to other systems or networks
  • Resell, redistribute, or sublicense the Service without written consent
  • Reverse engineer, decompile, or attempt to extract the source code of our systems
  • Abuse or exploit the Service in ways that degrade performance for other users

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

5. Payments and Billing

5.1 Balance System

CapBypass operates on a prepaid balance system. You add funds to your account and are charged per solved CAPTCHA task based on current pricing.

5.2 Payment Methods

We accept payments via Stripe (credit/debit cards) and Helekt (cryptocurrency). All payments are processed by these third-party providers under their respective terms.

5.3 Pricing

Pricing is listed on our pricing page and may change at any time. Price changes do not affect balance already purchased. You are charged the rate in effect at the time each task is solved.

5.4 Refunds

Refunds are handled on a case-by-case basis. Contact support via Discord for refund requests. We are not obligated to provide refunds for used balance.

6. API Usage

  • API keys are confidential — do not share them publicly
  • You are responsible for securing your API keys and rotating them if compromised
  • Rate limits and usage quotas apply and may be adjusted
  • We may throttle or suspend API access for abuse or excessive usage

7. Referral Program

CapBypass may offer a referral program that rewards users for inviting new customers. Referral rewards are credited as account balance. We reserve the right to revoke rewards obtained through fraudulent means (self-referrals, fake accounts, etc.) and to modify or discontinue the referral program at any time.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We are not liable for any losses resulting from service downtime, failed solves, or API errors.

9. Intellectual Property

All content, code, algorithms, models, trademarks, and materials on CapBypass are owned by us or our licensors. You may not copy, modify, or distribute any part of the Service except as explicitly permitted.

10. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPBYPASS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Account Termination

You may delete your account at any time through the dashboard settings. We may suspend or terminate your account for violation of these terms.

Upon termination, your remaining balance is non-refundable unless otherwise required by applicable law.

12. Indemnification

You agree to indemnify and hold harmless CapBypass, its operators, and affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

13. Governing Law

These terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation first, then through binding arbitration if necessary.
